This article examines the extent to which International Labour Organization (ILO) standards on unfair dismissal can be applied in Nigeria by challenging some important decisions of the National Labour Court (NIC) since the passage of the Third Amendment Act 2010. It examines the constitutional impediment to the application of ILO Convention 158 in cases of unfair labour practices related to Nigeria`s non-ratification of ILO Convention 158. The article argues that international best practices and labour standards, as formulated in ILO Convention 158, aim to promote the principle of natural justice, which is also constitutionally guaranteed for every person in Nigeria. In this regard, the article recommends that the NCI, in exercising its jurisdiction, base its decisions on the principle of natural justice as enshrined in the 1999 Constitution of the Federal Republic of Nigeria, until section 254 (C) (2) of the Constitution is further amended to allow for the application of international conventions by the court.
